How do I Adjust my Status?

Under certain circumstances you are allowed to “Adjust your status”.  You will need to discuss your situation with a caseworker to determine if you are eligible for this benefit.  If you are eligible please see the following:

 

The alien beneficiary will need to have a completed Medical Exam.

(the USCIS form I-693 http://www.uscis.gov/graphics/formsfee/forms/files/I-693.pdf   and I-693 vaccination supplement http://www.cdc.gov/ncidod/dq/pdf/ti-03/appdx-a_693vacc.pdf ) performed by an immigration approved Doctor. 

 

We will need from the Alien:

  • Birth Certificate (and translation if necessary)

  • Certified Marriage Certificate (and translation if necessary)

  • Divorce or Death Certificates of previous spouses – If any (and translation)

  • Passport and I-94 or any other documents issued to you by immigration – if any

  • Names, dates of birth and country of birth of all children

We will need from the US Citizen:

  • Birth Certificate (and translation if necessary)

  • Divorce or Death Certificates of previous spouses – If any (and translation)

  • Letter from employer – stating date of hire, salary

  • Last years Federal Income Tax Returns – all pages including all W-2’s

  • Last 2-3 recent pay stubs

  • Naturalization certificate – if any

We will need from both of you:

  • Your parent’s names- including mother’s maiden name, dates of birth, city and country of birth and city and country of residency.

  • Your addresses and dates you lived there for the last 5 years.

  • Your employers names and dates of employment for the last 5 years.

Since you will not be allowed to travel outside the US while your case is pending, we recommend that the alien, if they are eligible, to file for advance parole.  If you file for the advance parole when you file for Adjustment of status, the fee is and additional $180 ($170 INS, $10 to us for pictures).  If you do not file for advance parole at the same time as the Adjustment of status, you will have to wait 90 days for receipt and then an additional 10 weeks for the advance parole to be approved and the fee would be $230.

 

The papers we file for you will allow you to obtain a work permit and a Resident Alien Card.  You can file for a Social Security number after you receive the work permit receipt from Immigration.
